PRAVILA IN POGOJI

Pogoje za dostavo naših izdelkov in naše cene si lahko ogledate na naši spletni strani. Naše ponudbe so veljavne, dokler so na voljo tudi na spletni strani. Vse informacije so v skladu s francoskim civilnim zakonikom, člen 1369-4.  

Vračilo blaga

V skladu z gospodarskim pravom, člen L121-20, in z resolucijo dne 23. avgusta 2001, ima stranka po prejemu izdelka na voljo sedem dni, da ga preizkusi. V tem času lahko stranka izdelek vrne nazaj za menjavo ali pa za povračilo denarja - brez kakršnihkoli kazenskih posledic, na naslov naveden spodaj. Vendar pa bo stranka morala plačati vse stroške dostave blaga. V primeru, da je izdelek zamenjan za novega, bo le ta dostavljen stranki v roku sedmih dneh po vrnitvi prvotnega izdelka.

PLAČILNI POGOJI

Vsa plačila je treba opraviti preko PayPal-a, Vise, MasterCard-a ali na druge plačilne načine kot so čeki, bančna nakazila ali poštne denarne nakaznice.

Vse podrobnosti o bančnih računih naših strank bodo obdelane prek varnega gostiteljskega strežnika na PayPal-u. Prikaz le teh informacij na strani BrazilianBikiniShop.com je strogo prepovedan.

DOSTAVA

Stranke lahko sledijo statusu naročila z njihovim varnim uporabniškim računom na strani BrazilianBikiniShop.com.

Pri naročanju izdelkov mora stranka navesti želen naslov dostave.

Če stranka ob dostavi ne bo navzoča, bo v poštnem nabiralniku našla obvestilo o pošiljki. V roku 10 dni od prejetja obvestila o pošiljki mora stranka prevzeti paket na pošti. V primeru da je pošiljka prispela s hitro pošto, bo stranka prejela tudi dobavnico. Po prejetju le te, se mora stranka obrniti na dostavno službo in podati točen čas za dostavo. Stranka ima pravico, da izdelek naroči na katerikoli naslov. 

Vse informacije, ki zadevajo dostavo, bodo poslane po elektronski pošti.

BrazilianBikiniShop.com dobavlja po vsem svetu. Čas dostave je vedno približen. V primeru predolgih dostavnih rokov, to ne bo upravičevalo zahteve za povračilo stroškov. Vendar pa, če v 30 dneh od predvidene dostave, izdelek še vedno ne bo dostavljen (razen v primeru višje sile), je lahko vsak del tega sporazuma razveljavljen, stranki pa se v celoti povrne denarna vsota, ki jo je plačala za naročen izdelek, brez katerihkoli drugih vračil.

BrazilianBikiniShop.com ima pravico, da dostavo prekliče, če se le to pojavi kot posledica višje sile, na primer: vojaški spopadi, množični nemiri, požari, poplave, stavke, nesreče, nezmožnost dostave, …

V vseh primerih je pravočasna dostava naših izdelkov odvisna od izvajanja odgovornosti s strani stranke v skladu s tem sporazumom. Poštna pošiljka je lahko poslana kadarkoli in prek dostavnih služb kot so Deutsche Post ali Chronopost za hitre pošiljke.

Ko prejme izdelek, mora stranka pregledati dostavljeno blago in podati reklamacijo ali zavrniti izdelek, če je paket odprt ali če izdelek kaže očitne znake poškodb. Vse reklamacije je potrebno poslati dostavni službi s priporočeno pošto v roku 3 delovnih dni po prejetju izdelka. Kopija reklamacije mora biti poslana tudi na BrazilianBikiniShop.com. V skladu s francoskim gospodarskim pravom, člen L 133-3, zanemarjanje te odgovornosti v času navedenih časovnih obdobij razveljavi sprejetje kakršnihkoli ukrepov proti dostavni službi. V omenjenih okoliščinah BrazilianBikiniShop.com ne more predstavljati jamstva.

Če dostavljen izdelek ne ustreza opisanim standardom kakovosti, mora stranka podati reklamacijo v 15 dneh od prejema izdelka.

V primeru zamude, če je izdelek poškodovan ali pomanjkljiv ob dostavi, se lahko stranka obrne na naš Center za pomoč strankam. Če je bil nakup opravljen v elektronski obliki, se reklamacij za blago z napako ne sprejema v naših trgovinah. 

 

Izdelek bo dostavljen z:

  • Deutsche Post - Priporočeno za dostavo v katerikoli del sveta, z izjemo Francije in Italije.
  • La Poste - Najboljša izbira za dostavo znotraj Francije in njenih teritorijev.
  • Chronopost - Mednarodna hitra dostava znotraj Francije in po celem svetu.
  • SDA - Hitra dostava po Italiji.

Stranka bo prejela elektronsko obvestilo o odpošiljatvi blaga vključno s številko za sledenje statusu pošiljke. Ta sledilna številka se lahko uporablja na naslednjih straneh www.laposte.fr/csuivi, www.deutschepost.de, www.sda.it in www.chronopost.fr. V primeru kakršnihkoli pritožb mora stranka spletni trgovini BrazilianBikiniShop.com podati tudi sledilno številko izdelka, ki je prispel s priporočeno pošto.

Stranka prejme obvestilo o prejeti pošiljki v roku od 2 do 5 dni.

Po prejemu obvestila o pošiljki ima stranka na voljo 10 dni, da na pošti, ki je navedena na dobavnici, dvigne prejeto pošiljko. V primeru, da je ta rok prekoračen, bo izdelek poslan nazaj na  BrazilianBikiniShop.com. Center za pomoč strankam bo stopil v stik s stranko, da ta pretehta druge možne načine dostave naročenega izdelka, oziroma ima stranka pravico zavrniti pošiljko. 

Vendar pa, če v roku 5 dni od odpošiljatve pošiljke, stranka ni prejela nobenih informacij v zvezi z dostavo izdelka, mora iti le ta na pošto, ki se nahaja najbližje kraju navedenemu v naročilu. Če na pošti ni nobenih informacij v zvezi sistemom sledenja pošiljkam (www.coliposte.net www.chronopost.fr), mora stranka kontaktirati Center za pomoč strankam na BrazilianBikiniShop.com in povprašati o razlogih za ne-dostavo. Odzivni čas se lahko giblje od enega do treh tednov potem, ko je bila v BrazilianBikiniShop.com odprta preiskava.

- Če bo paket najden, bo bil le ta stranki znova poslan.

- Če je bil paket izgubljen, bo končna odločitev sprejeta v treh tednih.

PRITOŽBE IN VRAČILA IZDELKOV

V skladu z zahtevami iz 5. člena in ob upoštevanju časa potrebnega za vračilo izdelka, morajo biti vsi reklamirani izdelki vrnjeni v roku 15 dni od prejema izdelka. Le ta mora biti nov, celoten, ne umazan in neopran. 

Po preteku 15 dni vrnjenih izdelkov ne bomo sprejemali.

Vsi stroški in možnosti poškodb, ki lahko nastanejo ob vračilu izdelka so na odgovornost stranke. Če je bil izdelek vrnjen zaradi napake s strani BrazilianBikiniShop.com, bodo vsi stroški dostave v celoti povrnjeni s strani BrazilianBikiniShop.com. V takih primerih mora stranka to navesti na obrazcu za vračilo izdelka.

V primeru vračila, bo izdelek ob prejetju naša služba pregledala in potrdila, in povračilo stroškov bo izplačano na bančni račun stranke, katerega je le ta uporabila za plačilo, v roku 30 dni po vračilu izdelka.

 

Če bo izdelek vrnjen poškodovan, umazan ali ne celoten, naše podjetje ne bo izplačalo povračila stroškov.

V primeru kakršnekoli napake prosimo navedite vaše zahteve na obrazcu za vračilo. Ko je bil izdelek vrnjen, bo to pregledal in potrdil naš Center za pomoč strankam. Izdelki, ki so bili naročeni prek spleta, ne morejo biti vrnjeni v naše trgovine. Če je bil izdelek vrnjen zaradi napake, storjene s strani BrazilianBikiniShop.com, bodo vsi stroški dostave, ki jih je morala doplačati stranka, dodani k povračilu denarne vsote.

Za izdelek, ki je bil vrnjen poškodovan, umazan ali pomanjkljivo, vam podjetje ne bo moglo izplačati povrnitve stroškov.

Fraud prevention and the fright against fraud

The data collected is also used for fraud prevention and the fight against fraud, particularly with bank cards. BRAZILIAN BIKINI SHOP reserves the right to check the personal data given by the client when placing an order and to adopt all the measures judged necessary to verify that the person whose account is debited is in fact the person placing the order, in order to avoid any fraudulent payments. If there is no positive response from the customer, BRAZILIAN BIKINI SHOP reserves the right to cancel the order placed by the customer.

Debt collection

Who are the recipients of your personal data?

Bank information (bank details/IBAN) : 10 years starting from the end of the business relationship with the customer.

Prospects' data : 5 years from the end of relationship with the prospect.
