Acestor condiţii contractuale de vānzare, se supun toate vānzările contractate cu societatea noastra pe cale electronică.

Preţurile noastre sunt afişate per articol şi per referinţă. Īn plus, pe līngă preţul total al comenzii (adică suma preţurilor articolelor care compun lista) şi preţul final (suma  preţurilor  articolelor care cuprind comanda plus taxele de livrare) taxele de telecomunicaţii privind comanda, inerente la accesarea site-ului, rămān īn responsabilitatea clientului.

CONDIŢII DE VALIDITATE

Condiţiile de validitate a ofertelor de produse si preţurilor acestora sunt determinate de actualizarea site-ului cu colecţiile sau promoţiile noastre şi rămān aplicabile atāt timp cāt acestea rămān accesibile pe site, acest lucru este făcut īn conformitate cu articolul 1369-4 din Codul civil.

PERIOADA DE GĀNDIRE

Īn conformitate cu articolul L 121-20 din Legea Drepturilor Consumatorilor şi Ordonanţei din august 23, 2001, clientul primeşte o perioadă de gāndire de şapte zile de la livrare. Īn această perioadă clientul poate īntoarce produsul pentru schimb sau să-l restituie definitiv fără penalităţi, la adresa de mai jos. Cu toate acestea, costurile de returnare vor fi suportate de client. Costurile  poştale de returnare le suportăm noi, īn cazul unui schimb. Īn cazul unei cereri de rambursare, aceasta va avea loc īn termen de 7 zile de la īntoarcerea articolului.

4- Completaţi formularul de comandă.

5- Verificaţi dacă nu s-au comis erori īn comandă.

6- Validaţi comanda, preţul total şi preţul final.

7- Confirmarea primirii comenzii pe cale electronică de către brazilianbikinishop.com

8- Confirmarea comenzii pe cale electronică de către brazilianbikinishop, la data expedierii şi īn cazul indisponibilitaţii noastre eventuale.

9- Primirea comenzii.

10- Debitarea contului clientului cu suma preţului total al articolelor şi a costului transportului.

 

Odată cu completarea formularului de deschidere a contului, cu comunicarea datelor personale, a numarului cardului bancar şi a datelor confidenţiale şi a validării comenzii de către client, el se obligă să respecte condiţiile contractuale prezente, īn confrmitate cu articolul 1316-1 al Codului Civil.

PREŢ, FACTURĂ

Preţurile noastre includ toate taxele.

Pentru client se eliberează factură īn conformitate cu dispoziţiile sus menţionate prin aplicarea articolelor L 121-18 et L 121-19 din Codul Comercial.

CONDIŢIILE DE PLATĂ

Achitările cumpărăturilor se efectuiază prin Paypal, Carduri bancare (visa, mastercard) şi orice alt mod de plată acceptat de către paypal. Cecurile personale, viramentele bancare, mandatele poştale.

DATELE BANCARE

Paypal este unicul    mod, prin spaţiul său securizat, care are acces la informaţiile bancare ale clientului. Aceste informaţii nici intr-un mod nu sunt reflectate pe site-ul brazilianbikinishop.

Doar informaţiile legate de comenzi, sunt prelucrate automat.

LIVRAREA

Clientul poate urmări etapa īn care se află comanda sa, din contul său securizat de pe brazilianbikinishop.com.

Īn momentul efectuării comenzii, clientul trebuie să aleagă locul de livrare, la domiciliu, la birou, la o persoană terţă, īn staţiunea unde se odihneşte…

Īn cazul absenţei īn momentul livrării, la adresa indicată de către client, va fi lăsat un aviz de livrare īn căsuţa poştală: e posibil să ridicaţi coletul apoi la Oficiul Dumneavoastră Poştal timp de 10 zile de la data de cīnd a fost lăsat avizul. Dacă coletul este livrat de către curier, deasemenea va fi lasat un aviz īn căsuţa poştală a clientului. Clientul va fi rugat să contacteze curierul pentru a conveni asupra unei date de livrare. Clientul are posibilitatea să livreze articolele, către orice persoană doreşte, dacă aceasta are domiciliul permanent oriunde pe glob. Produsele vor fi livrate la adresa pe care clientul a indicat-o īn comandă.

Toate livrările noastre sunt anunţate prin e-mail.

Brazilianbikinishop livrează oriunde īn Franţa metropolitană (Inclusiv Corsica),  şi restul lumii. Termenele de livrare sunt īntotdeauna orientative. Depăşirea acestora, nu poate īn nici īntr-un caz să fie socotit ca motiv de anulare a comezii date şi nu dă drept la nici un fel de despăgubire.

Dacă timp de 30 de zile comanda nu a fost livrată, din motive alte decīt forţele majore, comanda poate fi anulată la iniţiativa oricărei părţi; cumărătorul putīnd obţine rambursarea fără nici o īntīrziere a sumelor achitate, excluzānd orice fel de compensaţie a daunelor şi intereselor. Sunt considerate ca forţe majore īn care brazilianbikinishop le are ca scuză de nerespectare a obligaţiilor de livrare : război, răscoală, incendii, inundaţii, greve, accidente, incapacitatea de a fi livrate…

Īn orice caz, livrarea produselor noastre cu īntīrziere, nu poate avea loc, dacă clienţii cunosc şi respectă obligaţiile lor faţă de noi.

Fiecare livrare este astfel efectuată, īncīt produsele să fie puse la dispoziţia clientului de către transportator, prin sistemele de control utilizate de către transportator, aşa ca sistemele de urmărire a livrării prin Internet oferite de către Deutchepost pe baza recomandărilor, sau acela oferit de către Chronopost pentru livrările expres.

Este de datoria destinatarului să verifice coletul la primire şi doar atunci să facă orice reclamaţie justificată, sau să refuze chiar coletul, īn caz că acesta prezintă urme de a fi fost deshis sau semne de deteriorări. Aceste obiecţii şi reclamaţii trebuie să fie adresate transportatorului, prin scrisoare recomandată, īn timp de trei zile lucrătoare, după livrarea produsului, o copie va fi imediat transmisă şi către brazilianbikinishop. Imposibilitatea de a face această solicitare īn timpul sus menţionat, va opri orice acţiune contra transportatorului, conform articolului L 133-3 din Codul Comerţului şi brazilianbikinishop nu va mai putea fi atrasă ca garant.

Īn cazul īn care produsele livrate nu corespund calitativ şi cantitativ specificaţiilor menţionate īn bonul de livrare, clientul trebuie să īşi manifeste reclamaţiile timp de 15 zile după livrare. Īn caz de īntīrziere, produs lipsă sau defect, clientul se poate adresa Serviciului Clienţi. Cīnd este vorba de o comandă pe cale electronică, nici o reclamaţie, de nici un fel nu poate fi rezolvată direct īn magazin

Coletul poate fi trimis prin:

  • Deutchepost – Recomandat, pentru livrările īn īntreaga lume excepţie făcīnd Franţa şi Italia.
  • Poşta - Lettre Max pentru livrările īn Franţa şi teritoriile dependente
  • Chronopost international, pentru livrările expres īn Franţa şi īn īntreaga lume.
  • SDA Express pentru Italia.

Clientul este informat prin e-mail despre livrare, cīnd i se comunică numărul de urmărire, pe care īl poate folosi pe următoarele site-uri: www.laposte.fr/csuivi, www.deutschepost.de, www.sda.it ou www.chronopost.fr. Īn cazul unor reclamaţii, clientul trebuie să ofere numarul de urmărire menţionat īn e-mail-ul trimis de către brazilianbikinishop.com. E nevoie de la 2 la 5 zile pentru a fi livrată, sau pentru a primi un aviz īn căsuţa poştală.

Din momentul cīnd clientul primeşte īnştiinţarea, el are 10 zile pentru a merge la Oficiul Poştal să īşi ridice coletul. Dacă aceast termen va fi depăşit, coletul va fi reīntors către brazilianbikinishop. Serviciul Clientelă vă face legătură cu clientul, pentru o eventuală retrimitere, sau īn cazul refuzului din partea clientului, pentru o rambursare a comenzii. Totuşi, dacă după 5 zile lucrătoare, clientul nu are noutăţi despre comandă, el tebuie să se apropie de cel mai apropiat Oficiu Poştal de adresa indicată pe comandă. Īn caz că nici Oficiul Poştal, nici sistemul de urmarire al livrărilor, (www.coliposte.net ou www.chronopost.fr) nu indică vre-o informaţie despre coletul dat, clientul trebuie să se adreseze la brazilianbikinishop cu ajutorul Serviciului Clientelă, care vor porni o anchetă asupra serviciilor Poştale. Timpul de răspuns al Poştei variază de la una la trei săptămāni, de la momentul primirii dosarului de către brazilianbikinishop.

- Dacă coletul este găsit, el este livrat clientului : procedura de recepţie urmāndu-şi cursul normal (depozitarea coletului , sau aviz de tranzit)

- Dacă coletul este declarat pierdut ( răspunsul final este formulat definitiv īn termen maxim, sau trei săptămīni)

RECLAMAŢII , RETUR

Fără a aduce vre-un prejudiciu dreptului clientului de a se răzgīndi, conform articolului 5, toate retururile din motive legale trebuie efectuate timp de 15 zile de la data recepţiei. Articolele trebuie să fie noi, īntregi, complete, cu etichetă, nespălate, ne uzate.

După aceste 15 zile, nici un retur nu va fi acceptat.

Riscurile şi costurile legate de retur sunt īntotdeauna pe seama cumpărătorului. Dacă returul se face din cauza unei erori de ale noastre, aceste costuri vă vor fi rambursate. Īn formular cumpărătorul va indica, dacă el vrea să obţină o rambursare, sau să i se ofere un credit.

Īn cazul unei rambursări, odată ce produsele au fost primite, verificate şi acceptate de către serviciul nostru, rambursarea sumei achitate se va face prin creditarea contului bancar corespunzător cardului bancar de pe care s—a efectuat plata īn timp de treizeci de zile de la primirea articolelor returnate de căte compania brazilianbikinishop.

Articolele returnate de către client incomplete, deteriorate, murdare, nu vor fi rambursate.         

Īn cazul unei creditari, indicaţi īn formularul de retur livrat cu comanda Dumneavosatră, cererea de creditare. Orice credit obţinut de pe urma unor achiziţii on-line, nu vor putea fi folosite direct īn magazin. Dacă returul este făcut din cauza noastră, costurile legate de acesta vor fi adăugate la creditul oferit.

Articolele returnate incomplet, deteriorate, murdare de către client, nu vor putea fi subiectul unui credit.
