INFORMATSIOON KLIENTIDELE

Meie toote peamine omadus on, et selle turustamine toimub Interneti vahendusel ja kooskõlas äriseadustiku artikliga L 111-1 (www.BrazilianBikiniShop.com).

TINGIMUSED

See, kui palju tooteid parajasti saadaval on ja mis need maksavad, määrab meie koduleht. Meie pakkumised on aktiivsed seni kui Te näete neid meie kodulehel väljas. Kogu informatsioon on kooskõlas Prantsusmaa tsiviilkoodeksi aktikliga 1369-4.

Otsuse kaalumine

Vastavalt äriseadustiku artiklile L121-20 ja otsusele, mis pärineb 23. augustist 2001.a, on kliendil seitse päeva arvates toote kättesaamisest õigus seda proovida. Nimetatud perioodi jooksul on kliendil õigus vahetada toode välja või küsida raha tagasi, pöördudes selleks allpool toodud aadressile, ning mingeid sanktsioone sellisele käitumisele ei järgne. Saatmiskulud tasub klient. Kui klient soovib toote teise toote vastu vahetada, saadetakse talle uus toode seitsme päeva jooksul pärast esmalt ostetud toote tagastamist.

Vastavalt Prantsuse tsiviilkoodeksi artiklile 1316-1 peaks klient väga rangelt järgima käesolevast kokkuleppest tulenevaid nõudeid konto loomise, vormide täitmise, toote tellimise, isikliku info edastamise, krediitkaardi numbrite ja muu konfidentsiaalse info kohta. 

HINNAD JA ARVED
Meie hinnad sisaldavad kõiki toodetele kohaldatavaid ja õigustatud makse.
Vastavalt äriseadustiku artiklitele L121-18 ja L121-19 peab iga klient arve saama.

TASUMISE TINGIMUSED
Kõik tasumised peaksid toimuma läbi PayPali või Visa, MasterCardi või muu maksevahendi abil nagu tśekid, pangaülekanded ja postitellimus.  
Pangakonto detailid
Kõik kliendi pangakonto detailid peaksid liikuma läbi Paypali turvakaugarvuti.  BrazilianBikiniShop.com Interneti-leheküljel on sellise info näitamine rangelt keelatud.
Andmete automatiseeritud töötlemise käigus peaks olema kuvatud vaid tellimust puudutavad andmed.

KOHALE TOIMETAMINE
Kliendid saavad jälgida tellimuse staatust oma isikliku profiili kaudu Interneti-leheküljel BrazilianBikiniShop.com.
Kliendid peaksid edastama toote tellimisel aadressi, kuhu kaup kohale toimetada.  
Kui klient nimetatud aadressil ei asu, jäetakse talle postkasti teade kohale toimetamise kohta. Sellisel juhul peab klient pöörduma 10 päeva jooksul postkontorisse, et sealt saadetis kätte saada. Klient saab kätte toimetamise teate ka siis, kui ta on teinud kiirtellimuse. Sellise teate kätte saamisel peaks klient teavitama kandjat sobivast kohale toimetamise ajast. Kliendil on õigus tellida toode ükskõik millisesse paika maailmas. 
Kogu kohale toimetamist puudutav info saadetakse e-posti teel.
BrazilianBikiniShop.com toimetab tooteid kätte üle kogu maailma. Kohale toimetamise aeg on alati umbkaudne. Raha tagasi küsimiseks on vaja, et oleksid täidetud teatud tingimused. Kui toode ei ole 30 päeva jooksul pärast eeldatavat kohale jõudmist ikka veel saabunud (v.a force majeure korral), on õigus käesoleva kokkulepe tühistada ja makstud summa makstakse kliendile tagasi. 
BrazilianBikiniShop.com võib lõpetada tellimuse kohale toimetamise, kui ilmnevad sellised force majeure'i liigid nad relvastatud konflikt, massirahutused, tulekahjud, steigid, õnnetused, kohale toimetamise võimatus... 
Kõigil juhtudel sõltub toote kohale toimetamise aeg käesolevast kokkuleppest tulenevate kliendikohustuste täitmisest. Toote kohale toimetamine toimub alati selliste kohale toimetajate vahendusel nagu  Deutsche Post või kiiretellimuste korral Chronoposti abiga.
Klient peaks toote kättesaamisel üle vaatama ja esitama kaebuse, kui toote pakend on lahti tehtud või kui tootel esinevad nähtavad vead. Kõik kaebused tuleb vedajale esitada registreeritud posti teel kolme tööpäeva jooksul arvates toote kätte saamisest. Üks kaebuse koopia tuleks saata ka  BrazilianBikiniShop.com'ile. Vastavalt Prantsuse tsiviilkoodeksi artiklile L133-3 muutuvad pretensioonid vedaja suhtes tühiseks, kui klient ei esita oma kaebust selleks ettenähtud aja jooksul ja sellisel juhul ei kanna BrazilianBikiniShop.com enam vastutust. 
Kui kätte saadud toode ei vasta spetsifikatsioonidele, peaks klient esitama oma kaebuse viieteist päeva jooksul arvates toote kätte saamisest. 
Kui toode jõuab kohale hiljem kui ette nähtud või on saanud kahjustada või muude vigadega, võib klient võtta ühendust meie abiteenistusega. Kui toode osteti elektrooniliste kanalite vahendusel, ei saa keabusi puuduliku toote osas esitada meie poodides. 
 
Toode toimetatakse kohale järgmiste vedajate abiga:
- Deutsche Post - Soovitatav vedaja igas maailmajaos v.a Prantsusmaa ja Itaalia.
- La Poste - Letter Max kohale toimetamiseks Prantsusmaal ja selle kõigis osades.
- Fedex - International Express kätte toimetamiseks Prantsusmaal ja kõikjal üle maailma.
- SDA - ekspress Itaalias.

Klient saab toote kohale toimetamise kohta elektroonilise teate, milles sisaldub ka toote jälgimise number. Jälgimise numbrit saab kasutada järgmistel Interneti-lehekülgedel:  www.laposte.fr/csuivi, www.deutschepost.de, www.sda.it ja www.fedex.com. Kaebuste korral peaks klient teavitama BrazilianBikiniShop.com’i jälgimise numbrist registreeritud kirjas.
Kliendipoolse kohale toimetamise teate vastu võtmine võtab aega 2 kuni 5 tööpäeva.
Pärast kohale toimetamise teadet on kliendil aega kümme päeva, et kohale toimetamise teates märgitud tellimus postkontorist välja nõuda. Kui klient nimetatud aja jooksul tootele järele ei lähe, saadetakse see BrazilianBikiniShop.com’ile tagasi. Kliendiga võtab ühendust abiteenistus, et leida ühiselt muu toote kohale toimetamise viis ja kliendil on õigus ka tootest loobuda.
Igal juhul tuleks kliendil pöörduda lähimasse tellimuses märgitud postiasutusse, kui ta  5 päeva jooksul arvates toote välja saatmisest toote kohale toimetamise kohta infot saanud ei ole. Kui postiasutuses jälgimise süsteemi (www.coliposte.net www.chronopost.fr) kohta infot ei ole, peaks klient võtma ühendust  BrazilianBikiniShop.com’i abiteenistusega, et kohale toimetamise tõrke osas selgust saada. Vastuse saamine BrazilianBikiniShop.com’ilt võib võtta aega üks kuni kolm nädalat, kuni uurimine läbi jõutakse viia.
- Kui pakk leitakse, saadetakse see kliendile uuesti
- Kui pakk on kaduma läinud, tehakse lõplik otsus olukorra lahendamise osas hiljemalt kolme nädala pärast

KAEBUSED JA TOOTE TAGASTAMINE
Vastavalt artikli 5 nõuetele ja võttes arvesse kaalumiseks kuluvat aega, tuleb tagastamine lõpetada viieteist päeva jooksul, arvates toote kätte saamise päevast. Toode peab olema uus, täielik, koos sildiga ja klient ei tohi olla seda pesnud. 
Hiljem kui viieteist päeva jooksul tehtud tagastamisi arvesse ei võeta.

Klient vastutab kõigi toote tagastamisega seotud kulude ja riskide eest. Kui toode tagastatakse seetõttu, et  BrazilianBikiniShop.com on teinud mõne vea, tagastab BrazilianBikiniShop.com teile ka kohale toimetamise kulud. Klient peaks seda tagastamise vormis kindlasti kajastama. 
Kui meie teenindusosakond on toote kätte saanud, üle kontrollinud ja kinnitanud, kantakse tagastamisele kuuluv summa kliendi pangakontole tagasi ja see toimub kolmekümne päeva jooksul arvates toote tagasi saamise kuupäevast. 
 
Kui tagastatud toode on kahjustada saanud, määrdunud või mittetäielik, ettevõte kliendile raha ei tagasta. 
Defektide esinemisel nimetage palun tagastamise vormil oma soov. Pärast toote tagasi saamist kontrollib meie ettevõtte klienditeenindus selle üle ja kinnitab vea esinemise. Neid tooteid, mis on tellitud online’is, ei saa meie poodidesse tagastada. Kui toode tagastatakse seetõttu, et  BrazilianBikiniShop.com tegi mõne vea, lisatakse kõik kliendi poolt kantud kohale toimetamise kulutused summale, mis kliendile tagasi maksmisele kuulub.
Kahjustada saanud, määrdunud või mittetäieliku toote tagastamisel ettevõte raha tagasi ei maksa.

Legal or regulatory requirements

We may be need to pass on your personal data in the event of legitimate requests by public authorities, particularly to meet requirements regarding national security, the fight against fraud or in accordance with the law.

Fraud prevention and the fright against fraud

The data collected is also used for fraud prevention and the fight against fraud, particularly with bank cards. BRAZILIAN BIKINI SHOP reserves the right to check the personal data given by the client when placing an order and to adopt all the measures judged necessary to verify that the person whose account is debited is in fact the person placing the order, in order to avoid any fraudulent payments. If there is no positive response from the customer, BRAZILIAN BIKINI SHOP reserves the right to cancel the order placed by the customer.

Debt collection

When the total amount of money due is not paid by the customer, it becomes outstanding debt. To this end, we may need to pass on your personal data to our debt collection service provider.

Who are the recipients of your personal data?

Proof of identity provided in the context of exercising the right to query, to access, to rectification or to object : 1 year starting from the date of receipt by BRAZILIAN BIKINI SHOP

Bank information (bank details/IBAN) : 10 years starting from the end of the business relationship with the customer.

Cookies : 24 months for Google Analytics and Facebook cookies and 13 months for all other cookies starting from when they are stored on the user's device.

Purchasing data : 5 years starting from the end of the relationship with the customer.

Prospects' data : 5 years from the end of relationship with the prospect.

At the end of these periods, we can then archive the data, notably to meet the limitation periods of legal and tax rules and those of legal proceedings.
